RBT only applies when vessel is underway

Following some reports RBT testing was occurring whilst at anchor, Michael Drake Principal Manager Boating Safety, Maritime Management Centre, Transport for NSW, has confirmed with RMS legal team that 'RBT only applies when a vessel is underway (i.e. not at anchor, moored or berthed at a wharf or marina)'.
This is set out in Section 21(2) and Schedule 1 of the Marine Safety Act. This section also provides that the conduct of RBT only by Police when Police reasonably consider that a person was operating a vessel whilst it was underway.
New South Wales is a state on the east coast of Australia. It borders Queensland to the north, Victoria to the south, South Australia to the west, the Tasman Sea to the east and surrounds the whole of the Australian Capital Territory.
