Major Events

Miracles do happen. Or, to be a bit more prosaic, common sense sometimes wins over legal-interpretation-finagling. According to the Appeal Court of New York, “having for its annual regatta” means exactly what we all knew anyway, ie that it was an on-going process that had already happened and is intended to happen again. CNEV is only a paper yacht club, has been disallowed its challenge for the America's Cup, and Larry Ellison's challenge through Golden Gate Yacht Club stands. Hooray. (And now perhaps a few more US courts will start handing down common sense decisions). Here are all the stories on the latest development in the very sorry America's Cup saga.

Telefonica Blue's request for redress - having touched bottom just before the start of the last VOR leg in Qingdao – has been denied. TB's skipper, Bouwe Bekking, pointed the finger at Race Management for not providing a suitable patch of water for racing, but the request was disallowed. During the hearing, the Jury chairman Bryan Willis agreed that Telefonica Blue's finishing position was probably made significantly worse after the boat grounded on an uncharted obstruction minutes before the start. But clearing the other hurdles in the redress rule (no fault of her own, and improper action by the Race Committee) was more difficult. Moral: there's “something in the water” in Qingdao, but it isn't on the chart. Full story below.

The Appeal Court of New York State this morning ruled in favour of the Golden Gate Yacht Club on the legitimacy of Club Nautico Espanol de Vela (CNEV), as Challenger of Record for the 33rd America's cup.
