Don't like the increases in your mooring/berthing fees? Don't grumble, do what the yacht owners in Malta did, and you just may win!

Two Malta lawyers have taken up the cudgel on behalf of the sailing-mad yacht owners of Malta (why wouldn't they be? right in the middle of the Mediterranean) and they are doing well.


Lawyers David Camilleri and Josè Herrera yesterday morning signed and presented a warrant of prohibitory injunction on behalf of 41 yacht owners, which was later provisionally upheld by the Law Courts of Malta.

The yacht owners sought legal action after they were told to sign a contract, by 15 April, which includes a number of clauses which the yacht owners said are 'unacceptable'.

The yacht owners’ main bone of contention is the rise in berthing fees, 'which have increased substantially'. Moreover, they argued that there is a clause in the contract which gives Transport Malta the right to further increase berthing fees when the authority deems fit.

They are also asking the court to stop the authority from transferring yachting berths to third parties or from doing anything to remove yachts from their present berths.

Transport Malta has six working days to reply to the yacht owners’ protests and the case will be heard before Mr Justice Joe Azzopardi on 28 April.
