NETHERLANDS REDRESS GRANTED
by Isabelle Musy on 28 Sep 2000
The international Jury deliberated all day upon Roy Heiner's redress.
The Dutch Soling skipper had lodged a request for redress alleging that
yesterday's tiebreak procedure for the Match Racing quarterfinal had been
incorrectly applied.
Heiner claims that, as he beat Kiwi Rod Davis yesterdays, he and not Davis
should move onto the semi-final.
Heiner had two wins and three losses in yesterday's quarterfinal so had
Norwegian Johannessen and Kiwi Roy Heiner.
Heiner's elimination occurred after a count-back to the fleet racing results
where Netherlands finished in third behind New Zealand and Norway.
The International Jury awarded Roy Heiner redress in respect of the tie
breaking procedure to be applied for the Soling Match Racing.
The Jury concluded that as the "Sailing Instructions could reasonably be
interpreted in favour of either boat, Netherlands is entitled to redress".
The decision was to conduct a sail-off one match between New Zealand and
Netherlands to decide 4th and 5th place in the QuarterFinal Round Robin.
The Jury have decided that this was the fairest arrangement to be made for
all boats affected.
The deliberation went on all day as the new composed international read
again carefully the sailing rules to decide that there were two
interpretations and that it would be as fair as possible to conduct a
sail-off.
The match will take place today (Thursday)morrow at noon.
