America's Cup Legal has had another round in the Appellate Division of the New York Supreme Court covering the issue of whether a rudder is part of a yacht's waterline length, or not - and, whether the Defender has the right to select any venue it likes.

Both parties issued their statements after the Hearing. It would seem that while no-one really wants to race in Valencia in February 2010, that is price of being unable to agree on anything - and that is where the regatta will be.

In this edition, we have a feature on the rudder issue. It is serious - as if the Appellate Division does not uphold the Supreme Court decision then BOR90 is about eight feet over length by our calculations and is disqualified.

There is the prospect of further Appeal on the decision expected before Christmas.

The DownUnder sailing season has begin in earnest. In Australia Sail Brisbane is underway. We've already started Sail-World's build up to the Rolex Sydney Hobart Race which will feature the Battle of the Supermaxis.

In Perth the Australia Cup is underway with a line up of international talent and the young BlackMatch Racing team looking to cement their 1 World ranking for the year.
