America's Cup news of various shades dominates this issue.
The Challenger of Record in the 33rd America's Cup has, Golden Gate Yacht Club, as expected, has filed an action for a Breach of Fiduciary Duty against the current Trustee and Holder of the America's Cup, Societe Nautique de Geneve.
This move is unprecedented in the history of the America's Cup, and is a new low-point for what used to be the premier trophy in sailing.
The media statement from GGYC was filed several hours ago, however it is believed that the suit was filed with the New York Supreme Court just before the expiry of the self-imposed 10 day deadline from their legal counsel, David Boies in a letter to the NYSC on 16 October.
The 20 page Motion is fairly damning, covering a number of points that have been publicly vented over the past two years, and also goes back into alleged property and financial dealings by Bertarelli family interests linked to the America's Cup - covering both Valencia and Ras al-Khaimah, the proposed venue for the 33rd Match.

In this edition we have the full release, including grounds for the Motion, plus links to the papers filed with the New York Supreme Court, which will go to Trial, rather than the series of Gearings and Decisions held to date.
We also feature the reaction from Societe Nautique de Geneve to the moves from the US Challenger. They're not happy.
The outcome sought is, as indicated in Sail-World.com several weeks ago, for SNG to be removed as Trustee and Event organiser and replaced with another independent and fit body. The Swiss club would remain as Defender and holder of the trophy.

There's another episode, this morning (Eastern time) in America's Cup Legal in the New York Supreme Court with a Hearing on the Venue selection and Rules motions. We have a short video interview with GGYC legal counsel, David Boies in this issue.

On the sailing side of the America's Cup, Alinghi are trialling a newer and longer mast in Ras al-Khaimah. BMW Oracle Racing are launching a re-vamped BOR90 (as they are still calling the Challenger). In this edition we have two photo galleries of images taken from outside the enclosure in San Diego showing the changes that have been made. Just in is an image gallery from the incomparable Gilles Martin-Raget taken aboard BOR90 yesterday in San Diego.

Via a web-cam we could see that the existing (MkII) mast for BOR90 being fitted, and it remains to be seen whether a hard wing sail will be trialled. The webcam is positioned in the Hilton Hotel in San Diego and is one of the ways hardcore sailing fans keep up with the latest America's Cup sailing action around the world.
We have a couple of great image galleries from Erik Simonson of www.h2oshots.com taken on San Francisco Bay of racing in the Finn Class at st Francis YC and the Great Pumpkin Pursuit race which attracted over 200 yachts.

From the Bahamas, we have a report, via ISAF, on the Sunfish World Championship - which proved to be a benefit for the US, in a number of ways.
The Melges 24 Worlds are underway on Chesapeake Bay, with a fleet of over 50 crews. So far two races have been sailed, and as might be expected, it is very close at the top of the points table. We have a report in this edition along with a couple of great videos.

From New Zealand we wrap up our coverage of the HSBC Coastal Classic, we are pleased to feature the video clip from ONE Sport's Martin Tasker aboard race winner and record breaker, Alfa Romeo, as she hotts along at over 20kts. We also feature the diary of images taken during Peter Burling and Blair Tuke's epic 120nm ride north in a 49er - an excursion which left them very sore, barely able to walk, but a great achievement nevertheless.

America's cup Challenger re-launched in San Diego BMW Oracle Racing Media,  On Sunday afternoon, the BOR 90 returned to its natural habitat as it was lifted by crane from its workspace into the harbour.
