Welcome to Sail-World.Com's NZ newsletter for 3rd April 2009 The SMS message on my iPhone this morning, from BMW Oracle Racing, was succinct 'Court decision:GGYC wins 6-0, Jane Eagleson'

That message has signalled the end of a rather sorry saga, which few outside America's Cup circles can understand.

Those inside that group would not, or should not have been surprised that events developed the way they did, as there has always been a flaw in the transition of the event from one cycle to another.

Insiders will also know that the America's Cup seems to go through this sort of cycle every 20 years, and emerges revitalised in a new form.

That will happen again, and the America's Cup is already well down that path.

You don't often get something for free these days, but this weekend you can get some outstanding entertainment at the Whitianga Festival of Speed. Paul Shanahan and his team have put together a great programme featuring powerboats, car and airchraft racing plus aerobatic stunt teams spanning Saturday and Sunday. We have re-run the story from Monday's edition, but check the website for the latest news. We hope to have an updated program on Friday. The Appeal Court of New York State this morning ruled in favour of the Golden Gate Yacht Club on the legitimacy of Club Nautico Espanol de Vela (CNEV), as Challenger of Record for the 33rd America's cup. The simple answer was that CNEV did not satisfy the requirements of the Deed of Gift, and therefore was not a bona fide club from which the Defender Societe Nautique de Geneve (SNG) could accep... America's Cup - NY Court of Appeals rules in favor of GGYC

The New York State Court of Appeals, in the case between Golden Gate Yacht Club (GGYC) and Societe Nautique De Geneve (SNG), regarding the validity of Club Nautico Espanol De Vela (CNEV) as the Challenger of Record, has found in favor of GGYC, reversing the Appellate Division and reinstating Justice Cahn's orders.... I Know A Yacht Club When I See One, And This Is No Yacht Club'

With those words Judge Herman Cahn sealed the fate of CNEV, the 'yacht club' that was formed, apparently, for the sole purpose of ensuring Ernesto Bertarelli's iron grip on the America's Cup. In an unusual but not unprecedented move, Judge Cahn and a number of New York State Supreme Court justices and their staffs flew to Valencia this past March to investigate the validity of the club in person.... Whitianga Festival of Speed gets underway this Friday

'Going Forward' is one of the most abused terms in the corporate vocabulary, but in the aftermath of the Appeal Court Decision from New York, there can only be forward momentum in the America's Cup. The current attitude of the general media seems to be overwhelmingly negative, as it always is towards anything, to do with the America's Cup, other than an America's Cup win.... [more]
