Port2Port Down Under Rally Pty Ltd - Notice of name change

As of Friday October 2nd 2015 the company Port2Port Down Under Pty Ltd has changed its name to Down Under Rally Pty Ltd.

The company however retains the same address , directors , shareholders , ACN and ABN . The only change is to the company name.

This change has been brought about as a result of a claim by the Bundaberg Cruising Yacht Club (BCYC) that the company name Port2Port Down Under Rally and as such the name of the rally itself infringed upon a registered trademark 'Port2Port' that is held by the Bundaberg Cruising Yacht Club.

At the time of registering the company name and until we received notification of this alleged infringement of trademark from the BCYC we were unaware of the existence of the trademark itself.

We have now entered into a licence agreement with BCYC which permits our use of the trademark 'Port2Port' for the remainder of the 2015 calendar year . This licence will expire as of 12 Midnight on December 31st 2015

In order to comply with the conditions of the licence agreement we in future must acknowledge on all documents and websites that contain the words Port2Port when referencing the rally the following disclaimer ;

'Port2Port' is a registered trademark of the Bundaberg Cruising Yacht Club'

We wish to advise that Down Under Rally Pty Ltd (formerly known as Port2Port Down Under Rally Pty Ltd) other than for the sole purpose of licensing the trademark ‘Port2Port’ is not now nor has it ever been associated with the BCYC or the Port2Port Yacht Rally that was previously run by the BCYC.

Moving Forward

We are in the process of removing any and all use of the words Port2Port from our website ,social media and all other event related content or promotional materials and we make the following requests of all parties that are in receipt of this communication;

- We request that any or all materials that any party may have obtained from any source in relation to the Down Under Rally that contain the words Port2Port be destroyed on or before the 31st December 2015

- We request that any future correspondence in regard to the event be made referring to ‘Down Under Rally’ only as the name of the event and that such correspondence, reference or promotion of the event in no way includes the words ‘Port2Port “ when referencing the event.

- We request that any party that is displaying the event name or Logo in any form of electronic media such as websites , change the event name to Down Under Rally and replace the logo with the revised version which is attached to this email in various formats.

We sincerely apologise for any inconvenience or confusion this change may create and reiterate that we were unaware of the existence of the registration of this trademark.

We also wish stress that the rally event itself , now know as the Down Under Rally, will be unaffected by this change.
